Terms and Conditions of Service

Service terms and conditions, including Covid 19 Clause

1.  In the event of a cancellation on the CLIENT's part once this agreement has been signed, COCKTAIL COACHING will retain the initial 50% deposit.  In the event of a cancellation within 2 calendar months of the commencement of the PROJECT, on the CLIENT's part, COCKTAIL COACHING will retain the fee and any funds paid in lieu of this PROJECT by the CLIENT.  In the event that this cancellation is ENTIRELY due to Covid 19 restrictions prohibiting the client to continue with the PROJECT at the planned time, COCKTAIL COACHING will retain all funds and reschedule the PROJECT at no further cost to the client.
2.  In the event of cancellation on COCKTAIL COACHING’s part due to circumstances outside its control, which are not the fault of the CLIENT and have no connection to Covid 19 circumstances, ALL paid funds will be returned to the CLIENT. COCKTAIL COACHING will not be held responsible for any further claims of compensation. In the event that this cancellation is ENTIRELY due to Covid 19 restrictions prohibiting COCKTAIL COACHING to continue with the PROJECT at the planned time, COCKTAIL COACHING will retain all funds and reschedule the event at no further cost to the client.

3.  In the event of cancellation due to AN ACT of GOD or FORCE MAJEURE, where circumstances are outside the control of both parties, neither party will be held liable to one another for any loss, financially or otherwise.       

4. CLIENT accepts immediate cancellation of PROJECT, if initial 50% balance is not paid in accordance with payment date stated on ‘Payment Schedule’. 

5. CLIENT acknowledges COCKTAIL COACHING will retain the initial 50% balance and cancel the completion of the PROJECT, should the final balance not be paid in accordance with the payment date stated within the ‘Payment Schedule’.

6. COCKTAIL COACHING enters into this agreement on the understanding that the CLIENT will be privately inviting only their own employees and colleagues to attend training and that the CLIENT is not acting as a third party agent for any organisation, that unapproved publicity or participant attendance will render this agreement null and void, the CLIENT will forfeit all monies paid, and the PROJECT immediately cancelled.

7. A breach of any of the conditions of this agreement or COCKTAIL COACHING policies by the CLIENT or any number of their participants, at any time, will result in the immediate cancellation of the PROJECT and the forfeiture of any monies paid to COCKTAIL COACHING in lieu of the PROJECT by the CLIENT.

8. COCKTAIL COACHING reserves its statutory right to recover any costs it may incur as a result of a breach of any conditions covered by this or separate or amended agreement(s) with the CLIENT pertaining to this PROJECT.
